America's Job Exchange is pleased to provide our OFCCP Compliance Solution. This solution delivers the appropriate information to each of the 50 states in order to help our customers in meeting their Federal Compliance Job Listing obligation.

On September 7, 2007, America's Job Exchange began forwarding job postings from companies that have identified themselves as Federal Contractors to the appropriate employment delivery systems in each of the 50 States, in response to the August 8 ruling from the Office of Federal Contract Compliance Programs.

Data transmission takes place in one of the following ways:

  1. FTP transfer of data file: A number of states subscribe to America's Job Exchange and we regularly prepare files to download for use in their state labor systems. This file includes both Federal Contractor and non-federal contractor jobs.
  2. Email of job listings to designated state level recipient: In cases where a state is allowing for a single email of jobs listing to be sent to a central location, America's Job Exchange sends an email of federal contractor job postings to that location. That location then distributes jobs to the appropriate offices.
  3. Email transfer of job descriptions: For those states that do not have a designated recipient or a subscription agreement with America's Job Exchange, we email the Federal Contractor job listings to the Comprehensive Career One-Stop Offices in the appropriate state based on the location where the job opening occurs.

We believe that these steps will help federal contractors meet the 41 CFR 60-300 requirements as described in the final rulings announced by the Department of Labor on August 8, 2007. However, given the rulings are relatively new, interpretations of the rulings may change or vary.

America's Job Exchange continues to monitor the changes and update the compliance mechanism on an as-needed basis. Please stay posted for new features and functionalities on compliance reporting as well as compliance processes for those who fall under the 41 CFR 60-250 requirements.
